THE AGREEMENT

Terms of Service

Effective September 9, 2026 · Version 1.0

These Terms are a contract between you and Xtronix LLC, the Florida limited liability company operating TownSwoop. By creating an account or using TownSwoop, you agree to these Terms and acknowledge the Privacy Policy. If you use TownSwoop for a business, you confirm you can bind that business.

1. Eligibility and accounts

You must be at least 13 and legally permitted to use TownSwoop. If you are under the age of majority where you live, a parent or legal guardian must approve and supervise your use. Providers must be able to enter a binding contract and operate lawfully.

Give accurate information, protect your credentials, and report unauthorized access. You are responsible for activity through your account. One login may manage multiple businesses; each must have accurate, separate details.

2. TownSwoop’s role

TownSwoop provides marketplace discovery, scheduling, messaging, business-management, payment, and related technology. Providers are independent businesses. Unless we explicitly say otherwise, TownSwoop does not employ providers, perform their services, set professional methods, verify every claim, or guarantee a result. A booking forms an agreement between the customer and provider.

Providers are responsible for licenses, permits, insurance, taxes, staff, service quality, accessibility, safety, pricing, and compliance. Customers are responsible for accurate booking information, being available on time, and paying agreed charges.

3. Listings, bookings, changes, and cancellations

Providers must keep services, prices, duration, availability, location or service area, and cancellation terms accurate. Customers must review the final service, options, time, location, and amount before confirming.

Availability can change until confirmation. Providers may set same-day notice, preparation time, deposits, prepayment, cancellation windows, and waitlist rules. Changes and cancellations follow the terms shown at booking and rights that cannot be waived by local law. A customer may message the provider after a deadline, but the provider need not approve a request.

4. Payments, refunds, and subscriptions

Providers may accept payment at the appointment or use Stripe-hosted checkout. Stripe, Apple, or Google may process payments or subscriptions, and their terms also apply. Providers are responsible for charges, taxes, receipts, refunds, chargebacks, and customer disputes unless law says otherwise.

Paid provider plans, per-business fees, renewal terms, and included features will be shown before purchase. Recurring subscriptions renew until canceled through the processor or store. Deleting a TownSwoop account or uninstalling the app does not cancel a subscription. Cancel through Apple, Google Play, or the TownSwoop billing portal before deleting the account. Cancellation stops future renewal and does not automatically refund the current term except where required by law or stated at purchase. Beta and founding access may change before commercial launch with reasonable notice.

5. Messages and notifications

Use appointment messages for legitimate service communication. Businesses may enable an editable automatic reply, which TownSwoop labels. Notifications and calendar entries are conveniences and can fail because of network, device, or provider issues. Keep your own record of time-sensitive obligations.

6. Your content

You keep ownership of content you submit. You give TownSwoop a worldwide, nonexclusive, royalty-free license to host, store, reproduce, format, display, and distribute it only as needed to operate, promote, secure, and improve TownSwoop.

You confirm you have the rights and permissions needed for uploaded content and that it is accurate, lawful, and respects privacy, publicity, intellectual-property, and other rights. We may remove content that violates these Terms, Provider Standards, law, or safety requirements.

7. Acceptable use

  • Do not use TownSwoop for unlawful, fraudulent, deceptive, dangerous, or abusive activity.
  • Do not impersonate others or misstate licenses, pricing, availability, location, reviews, or qualifications.
  • Do not harass, discriminate, threaten, exploit, invade privacy, upload malware, probe security, bypass controls, or interfere with operation.
  • Do not manipulate bookings, payments, reviews, promotions, subscriptions, or account limits; misuse customer information; or copy TownSwoop branding, software, or content without permission.

8. Maps, directions, and safety

Maps, pins, addresses, service areas, distances, and directions may come from users or third-party services and can be incomplete, particularly where street addressing is limited. Confirm locations directly before travel. Use reasonable care for in-person appointments and contact local emergency services when necessary.

9. Third-party services

TownSwoop may work with Stripe, Supabase, Apple, Google, Hostinger, calendar providers, map providers, and others. Their own terms and policies apply. TownSwoop is not responsible for a third party’s independent service, content, availability, or conduct to the extent permitted by law.

10. Suspension, termination, and deletion

You may stop using TownSwoop or delete your account in the app. We may hide content, restrict features, suspend, or terminate access when reasonably necessary to protect users or TownSwoop, respond to law, address nonpayment, or enforce these Terms or Provider Standards. When practical, we will give notice and an opportunity to correct the issue.

11. Disclaimers and liability

To the extent permitted by law, TownSwoop is provided “as is” and “as available.” We do not warrant uninterrupted operation, error-free information, a minimum number of bookings, provider quality, customer conduct, payment outcome, or suitability of a service. Non-waivable warranties and rights remain in effect.

To the extent permitted by law, Xtronix LLC and its officers, employees, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or loss arising from customer-provider interactions. Aggregate liability will not exceed the greater of what you paid TownSwoop in the prior twelve months or US $100. These limits do not apply where law prohibits them.

12. Governing law and changes

Florida law governs these Terms except that mandatory consumer protections where you live continue to apply. Contact admin@townswoop.com before filing a claim so we can try to resolve it. Courts with lawful jurisdiction may hear unresolved disputes. These Terms do not require arbitration or waive rights that cannot lawfully be waived.

We may update these Terms as TownSwoop changes. We will post a new effective date and give additional notice when required. If one provision is unenforceable, the rest remain effective.
